Kay, hereinafter referred to as petitioner, as owner of Lot Eleven (11) of Block 111, in Nichols Hills Suburban Tracts Addition to Oklahoma City, Oklahoma, (9208 North May Avenue) filed his application with the City Building Superintendent of Oklahoma City (William J. Burkes), as respondent, requesting that he be issued a building permit to erect a one story addition to his property and alter and convert the existing residence thereon to a one story office building. Petitioners application was denied.
